SIGNING THE WRONG DOCUMENTS CAN COST YOU MILLIONS.
It is wise to desist from signing documents for people, when you don’t even know them or what they are becoming. Some people don’t even know that there is a great difference between a Guarantor, Surety and a referee. They are not the same, as one mistake can put an individual into serious debt.
Let’s break it down clearly.
A. GUARANTOR
You are saying;
Þ If this person refuses to pay AFTER the lender has tried everything…. I will pay”
You are the last line of pay. Don’t be deceived, the last line still gets called.
Total Liability; Responsible for the entire unpaid balance if default occures.
Credit Damage; Missed payments by the borrower lower the guarantor's credit score.
Legal exposure; Lenders can sue the guarantor or ganish wages to recover the funds.
No Ownership: Guarantor pays off the debt but receive no rights to the asset.
B. SURETY
This one is a trap many don’t even understand.
You are saying;
Þ “If this person misses payment, come to me immediately”
No waiting
No chasing the borrower
You are equally responsible from day one.
In Further Context
As a Person: An individual who tells to the court that an accused person will show up for trial, or someone who promises to pay another's debt if they fail to do so.
As a Financial Guarantee: Money, property or formal surety Bond pledged to ensure a contract or financial obligation is fulfilled.
As Certainty: A semi- formal use meaning the state of being completely sure or confident about something.
The Guarantor and Surety are individuals or entities that agrees to take on the responsibility of fulfilling a financial obligation if the primary borrower defualts.
C. REFEREE
This one is safe
No Financial Liability: unlike a guarantor (who has secondary liability) or a surety (who shares equal, immediate liability) a referee merely vouches for a person's character, reputation, or identity.
Privity Of contract: you are not a party to the underlying financial agreement or contract (such as loan or lease); therefore, you cannot be sued or held financially liable if the applicant defaults or breaches the contract.
Misrepresentation Risk: the only theoretical legal risk arises if you intentionally provide a fruadulent or maliciiously false statement knowing it will induce reliance which could expose you to claims of fruad or misrepresentation,though this has an exceptionally high legal threshold.
So, if someone comes to you;
That “just help me sign” can become
Þ Years of financial burden
Þ Broken Friendships
Þ Endless Pressure
Next time anyone calls you
“Abeg just stand for me”
Ask them:
Þ As WHAT exactly?
· Guarantor= Future payer
· Surety=Immediate payer
· Referee= Just character witness
Never sign any document without reading and understanding it completely because your signature makes it legally bpund to its terms.
Why your signature matters
legal binding: The law assumes you read and agreed to everthing on the paper once you sign.
No excuses: saying " i did not read it" or I did not understand It" will not protect you in court.
Always read through any documents before signing, don’t give in or allow emotions becloud your thoughts.
