COURT ROOM DECORUM

THE NEED FOR COURTROOM DECORUM

A courtroom is not an ordinary place. It is a place where disputes are resolved, rights are protected, evidence is examined, and justice is administered. Because of the important role the judiciary plays in society, everyone who enters a courtroom—judges, lawyers, litigants, witnesses, court officials, security personnel and members of the public—has a responsibility to maintain proper decorum.

Courtroom decorum refers to the appropriate behaviour, respect, discipline and level of seriousness expected within a court of law. It is not merely about sitting quietly or dressing properly; it is about recognising the authority of the court and conducting oneself in a manner that preserves the dignity and integrity of the judicial process.

One of the most important reasons for maintaining courtroom decorum is respect for the administration of justice. Courts exist to provide a peaceful and orderly mechanism for resolving disputes. If people shout, insult one another, interrupt proceedings or disregard the instructions of the judge, the court can quickly lose the atmosphere necessary for justice to be properly administered.

Courtroom decorum also promotes fairness and impartiality. Judicial proceedings require concentration and careful consideration of evidence and arguments. Unnecessary noise, emotional outbursts, intimidation or disorder can distract the court and potentially interfere with the proper presentation of a case. Every party deserves an environment in which his or her case can be heard fairly.

For lawyers, courtroom decorum is particularly important. Counsel are officers of the court and are expected to conduct themselves professionally. Advocacy does not require insults, unnecessary aggression or disrespectful language. A lawyer can strongly challenge an opposing argument while remaining courteous and respectful. Professional disagreement should never become personal confrontation.

Litigants and members of the public also have a duty to behave appropriately. A person who is unhappy with a decision of the court may have lawful avenues available, including an appeal where permitted by law. Shouting at the judge, insulting opposing parties or disrupting proceedings does not change the decision and may create additional legal consequences.

Witnesses must equally understand the importance of decorum. They should answer questions truthfully, clearly and respectfully and should avoid arguing with counsel or engaging in unnecessary confrontation. The courtroom is not a place for settling personal scores or displaying anger.

Proper dressing is another visible aspect of courtroom decorum. While standards may vary according to jurisdiction and the particular court, persons appearing before a court should dress in a manner consistent with the seriousness and dignity of judicial proceedings. Appearance communicates respect for the institution and for everyone participating in the process.

Courtroom decorum is also essential because justice must be seen to be administered with dignity. Public confidence in the judiciary is strengthened when proceedings are conducted in an orderly, respectful and professional manner. A courtroom characterised by disorder and disrespect can undermine confidence in the justice system.

However, decorum should not be misunderstood to mean that people must remain silent about genuine concerns. Parties have the right to present their cases, lawyers have the right to advocate for their clients, and individuals may challenge decisions through lawful procedures. The important principle is that such rights must be exercised through proper legal channels and with respect for the court.

Ultimately, courtroom decorum is everyone's responsibility. The judge must maintain order, lawyers must uphold professional standards, litigants must control their emotions, witnesses must behave respectfully, and members of the public must recognise the seriousness of judicial proceedings.

A courtroom should therefore remain a place where reason prevails over emotion, evidence prevails over accusations, and law prevails over disorder. Respect for courtroom decorum is not simply a matter of tradition or appearance; it is an essential part of preserving the dignity of the judiciary and ensuring that justice can be heard, considered and delivered fairly.
